What is H.R. 1844?
(Updated July 18, 2020)
This bill bans forced arbitration of an employment, civil rights, consumer or antitrust dispute. The bill also declares that validity to arbitrate can only be determined by a court. Exempted from the bill's provisions are arbitration provisions in a pre-existing contract between an employer and a labor union, or between two labor unions.
Argument in favor
Would disallow powerful entities from opting out of federal laws and the civil court system.
Argument opposed
While some are abusively manipulating the process, banning forced arbitration altogether is rash.
