UPDATE - 6/2/20 (3:55pm EDT): The Senate voted 51-40 to invoke cloture on Brian Miller's nomination to be Special Inspector General for Pandemic Recovery. The vote went mostly along party-lines, with all Republicans and Sen. Doug Jones (D-AL) in favor, and all other Democrats opposed. A confirmation vote will occur later today.
The Senate is expected to vote Tuesday on the nomination of Brian Miller to be Special Inspector General for Pandemic Recovery (SIGPR) at the Treasury Dept. Here’s what you need to know about the nominee.
Who is Brian Miller?
- Miller is an attorney who served as the Inspector General of the General Services Administration during the administrations of George W. Bush and Barack Obama from August 2005 to May 2014.
- Prior to that, Miller was an advisor to the U.S. Deputy Attorney General and an Assistant U.S. Attorney for the Eastern District of Virginia during the Bush Administration.
- More recently, Miller served as Associate White House Counsel and Deputy Assistant to the President from December 2018 to April 2020 during the Trump administration.
- He left that position after he was nominated to serve as SIGPR, a position created by the CARES Act to oversee lending programs by the Treasury & Federal Reserve, which is subject to appointment by the president & confirmation by the Senate.
What’s the outlook for his nomination?
- Miller went through a contentious confirmation process in the Senate Banking Committee, but his nomination was ultimately advanced on a mostly party-line 14-11 vote.
- All Republicans and Sen. Doug Jones (D-AL) voted to advance Miller’s nomination, while all other Democrats on the committee opposed his nomination.
- Some Democrats have expressed concerns that Miller’s personal ties to the Trump administration would undermine his independence.
- During his confirmation hearing, Miller said that he would “immediately” inform lawmakers if he was asked to withhold information, and would view the allotment of relief money on political grounds as a potential violation of the law that he’d investigate.
- A simple majority is required to confirm Miller on the Senate floor, so it’s likely he will be confirmed with support from Republicans, Jones, and possibly other Democratic senators.
What does the Special Inspector General for Pandemic Recovery do?
- Created by the CARES Act, SIGPR will work within the Treasury Dept. subject to appointment by the president & confirmation by the Senate.
- They will conduct, supervise, and coordinate audits & investigations on the making, purchase, management, and sale of loans, loan guarantees, and other investments made under the CARES Act.
- The Special Inspector General will make quarterly reports.
