A Major Victory for the Second Amendment
We scored a huge victory!!!
Yesterday, supporters of the Second Amendment scored a historic victory in the fight to keep and bear arms.
In a 2-1 decision issued on February 13th, the Ninth U.S. Circuit Court of Appeals ruled that "San Diego County violates the Constitution's Second Amendment by requiring residents to show “good cause” before being allowed "to obtain a concealed carry permit."
The courts ruling is a huge victory for gun owners as the decision asserts that the Second Amendment cannot be limited to one’s own home and the right to use guns for protection outside the home is explicitly protected by the Second Amendment.
According to judge Diarmuid O'Scannlain who issued the majority opinion in the case, “The Second Amendment must be read as including "the right to carry weapons outside the home" because "the risk of armed confrontation" is in no way limited to one's home.”
The decision is in direct contrast to federal decisions in New York and New Jersey where similar restrictions on concealed carry have been upheld.
With the decision by the U.S. Circuit Court of Appeals it is very likely that we will see similar complaints filed across the country. Gun owners have scored an important and decisive victory!
