Under the listed circumstances it seems to me to be a hate crime. If journalists aren’t protected under those laws, they should be, in my opinion. I think we should define “journalist” clearly, though, and defined behavior that is protected. There are those claiming to be journalists that engage in aggressively provocative tactics and voyeuristic behavior. There are those who ignore requests for space or to stop. Non-journalists should have their privacy, physical safety, and dignity respected, too. Maybe consider the restrictions placed on cops pursuing an investigation - if a cop can’t do it, should a journalist and why?
