Often times people are "barred" from the United States only for previously living here without status in the past. Often times these people are trying to come back to the US to be with their spouses, children, or parents who may be citizens or legal residents. It is immoral to jail someone for five years just for crossing an imaginary line in order to live with their loved ones. Often people who are deported are barred from coming back for 10 years without a waiver to come sooner. Being gone 10 years means missing their children grow up. Until we have a legal way for such people to come back with authorization then we cannot criminalize coming back to this degree.
