This is just a ploy for employers to have their cake and eat it too! This takes not only from the employee who was classified incorrectly but also all of the employers in your state who classified their employees correctly. This robs people of their unemployment benefits of the company fails or gets caught and they shut the doors. It fuels more inequality and allows the employer to break the law. Contract employees are by definition a partner in the gains as well as the losses made by the so called gig employers. The constitution says liberty, justice, and the pursuit of happiness for the people and not just for the oligarchs.
