I was a jurist on a medical malpractice suit where the defendent's egregious actions resulted in the patient's death 5 years earlier. A crowded court calendar and defendent's delaying tactics would have the family from acknowledgement of the defendent's egregious actions. The states rule over its own cases. There are too many variables for a blanket, federally mandated law to apply to malpractice claims. Tort reform is needed but when it penalizes the plaintiff it is wrong. The states need to clean their own house not the federal govt.
