How is the governing body supposed to determine that the person doing the assaulting is doing it because it's a police officer? Someone robbing a bank may shoot at a police officer when they arrive, not because they're a police officer but because incapacitating them is the way they can escape. Someone involved in a drunken brawl may attempt to hit the police officer holding him back, should that be viewed as a hate crime against police? I believe that hate crimes against police do happen (as they happen to racial minorities, among others) but this law would not be a sufficient way to deal with the problem, and could be easily corrupted (it already reads like a fear threat from the government).
