This is s false choice. Because the president can nominate whomever he might like. Of course. BUT, the Senate can and should confirm or deny at their direction. Including waiting to hold confirmation hearings until after the new president takes office. That is exactly what Barack Obama, Harry Ried, Chuck Shumer, Joe Biden, and so many others argued passionately before. It is so profoundly disappointing that they now pretend they think it is somehow unfair to take the very actions they all argued prior. And btw - Bernie Sanders, the Republicans are not suggesting (nor could they in fact) denying president Obama from nominating anyone. Be honest with the American people, and with your supporters especially. And Hillary Clinton, in fact it IS the precedent.
