Please note that this issue refers to a "first strike", not a "retaliatory strike". The bill simply restates in other languages what already exists in law. Only Congress has the power to declare war, and a first strike implies we are going to war, so this issue is already covered by the Constitutional separation of powers. In the recent past, Congress has neglected its duty at times and the Executive branch has overextended its powers in this regard, e.g. Vietnam, Iran, Iraq, Libya, Afghanistan. These are murky waters, but the Constitution is clear. We do not need another pointless law on the books that cannot be implemented and is already in fact stated in the Constitution. We simply need to act to enforce the law that exists. We can begin by returning to a Congress that fulfills its responsibilities under the Constitution, thereby limiting the power of the Executive branch. This would improve far more issues than the involvement of our country in undeclared wars!!
