AS AN INITIAL MATTER, I believe abortion should be unlawful except in very limited circumstances (e.g., rape, incest, atypical health risk to the mother). HOWEVER, while I adamantly believe Roe v. Wade was wrongly decided and should be overruled with all deliberate speed, I also am equally certain that our Constitution does not confer upon Congress the power to enact this particular measure into law. Put simply, I would support without reservation the passage of an identical measure at the State level, but upholding the rule of law requires opposing this particular bill because it is clearly unconstitutional for Congress to enact it as federal law.
