The President is obligated to appoint a new Supreme Court Justice and the Senate is obligated to "advise and consent". Only under extraordinary circumstances should the Senate reject a Supreme Court Nominee. If the Senate refuses to preform their Constitutional obligations the President should fill the vacancy through a recess appointment. Using the argument some Senators are currently using to block any nomination no one in the Senate whose seat expires and no Representative in the House should vote on any legislation until 2017.
