This is bordering on the least important thing Congress could be debating. It is not Congress's job to regulate emails. Not your call. If I find the inability to opt out of a company's emails frustrating, I'm going to do two things: (1) set up a filter in my email so that they go straight to the trash folder, and (2) stop patronizing that company. If enough people do that they get the message loud and clear, and they adjust their practices accordingly. There, no federal overreach required.
