The statement made by the ERA Coalition says all you need to know,as to why the ERA Amendment shouldn’t be ratified: “The ERA Coalition has centered the perspectives and participation those who lives are most impacted by systemic inequalities, including gender-non comforting and transgender women and girls, and non-binary people.”
Ratification of the Amendment can provoke unintended consequences, such as prohibiting sex-segregated bathrooms, and “protecting” a transgender male’s “right” to compete in female sports. It could also lead to fortification of abortion rights, including those that are given near-birth.
People hope to ratify the ERA, which was written based on the morals and values of 1972, so they can claim it protects what some now consider to be moral and just in 2021.
Those that want an amendment to allow immoral and unequal rights (as mentioned earlier), should introduce legislation that addresses their true intentions, where the specific protections sought are laid out clearly, and then voted on.
When one looks at the Preamble of the Constitution of the United States of America, they should consider whether equal protection between men and women already exists: “We the People of the United States, in order to form a more perfect Union, establish justice, insure domestic tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”
The Preamble does not relegate the rights protected by the Constitution to only men. IMHO, women already have equal protection under the Constitution.
If people today want legislation to address concerns of today, they should draft and propose legislature today.
