The First Amendment forbids Congress from interfering with freedom of religion, speech or press. On this basis, one could argue that this Act is unconstitutional. However, the church pulpit is no place for politics. It will divide congregations along political lines and drive people from their chosen church. That does not square with freedom of religion. In addition, if tax exempt organizations (501c3) are allowed to get involved in political activity, where will it stop? Super PACS getting tax exemption status?
