It’s insane to prosecute women for making rape accusations. The burden of proof for a criminal conviction is incredibly high, because it’s better to let a guilty person go free than for an innocent person to be punished. Just because we aren’t certain enough of one person’s guilt to warrant punishment doesn’t mean that person is innocent, and especially not that anyone who thinks otherwise is themselves a criminal. Malicious, false accusations are incredibly rare and almost never survive an investigation, much less a prosecution. But true accusations that can’t be proven beyond a reasonable doubt are really, really common. That’s why so many victims don’t report, and prosecuting the ones who do will only make certain even more rapists walk the streets.
