Over two years ago the NY Times quoted a Bishop (I forget which one) who said the Church was not concerned about same sex marriage but was spending all its money on preventing the Child Protection Act being passed. Cuomo met with the Bishops who told him that he could have the same sex marriage law as long as he did not pass the Child Protection Act. This is Separation of Church and State? This means people are being married over the raped bodies of children.

I also know individuals personally who have sexual intercourse with their father and still communicate with him as a family. First, it’s important to remember that no one gets monetary rewards when someone is convicted in criminal court. Survivors and their allies are so passionate about this issue because they long to see their abusers behind bars- both to feel some semblance of justice, and so they can live their lives no longer haunted by thoughts of “if I had come forward sooner, the person who did this to me would no longer be hurting children”.

That said, justice in criminal courts cannot be granted to someone who was once time-barred due to a Statute of Limitations. But retrospective trials in civil courts are constitutional, and one year in which to hold such trials is a feature of the Child Victims Act. And here’s what it would mean to me- I could sue my father for raping me. He has no remarkable assets, and a large chunk of what he has would pay for a defense attorney.

So realistically, if I were to sue him, I’d lose money in the long run. What I’d gain would be court documents saying “the court believes you did this”. Those documents would keep him from being able to adopt or foster children- something he is perfectly capable of doing right now. The media tends to focus on children abused by big institutions, and criminal and civil actions against them. That makes it easy to forget that approximately 46% of child sex abuse cases are incest.
