The omission to provide, or animal cruelty is the crime to be charged here. If he really can't see intent then it is neglect which doesn't require it as an element of the crime. It is not necessary to have intent for the failure to provide reasonable or ordinary care. The prosecutor is using jargon in an attempt to confuse the ordinary citizen with what "elements" of a crime consist are . This is cronyism at it's best. Anybody else would have been charged.

The officer was a fault here. If he left the dog in a hot car for too long, he knew the end result. I see it as negligence.

its the death of a police dog, if he killed a human officer he would have to answer for it, same for the dog he didn't get to choose to join the force.

If the officer was in active duty and had no choice to leave the dog in the car and could not get back to the dog sooner then I understand. But this does not seem to be the case. I have no doubt that if any of us normal citizens left our dog in the car and the dog died as a result of the heat, we would be arrested and charged of negligence! Accidents happen though and maybe we just don't have all the information. Still, why aren't they giving us all the facts?

I can't believe this. Some cops came into a restaraunt here to get the owners of the vehicle with a dog locked inside, gave it, water and talked to the owners. Don't know if there was a fine involved.

if you hurt a police dog while they are performing their work you will be charged with assaulting a peace officer, why should this be any different? we as tax payers paid to train this animal to do a very specialized type of work for us, and thru neglect byhis handler was killed - at least manslaughter charges should be filed against this officer.

That is just horrible... If you are warm in 95 degree heat imagine how a animal feels with all their fur...I was told once that they feel the heat at least 10 degrees more then a human....So sorry to hear this news....

I support some charges against the Officer but I absolutely oppose any thought of discharging this man. It was inexcusable but was an accident no matter how people want to describe it and demonize the man who puts HIS OWN HUMAN LIFE ON THE LINE EVERY DAY.
