Do you know if she has a Guardian ad Litem? She should in a situation like this to give her a voice.
Bryanna- Please ask your lawyer or someone in the know. I know that you can be appointed a Guardian ad Litem who will go into court and represent your voice.
In reality The Gardian Ad Litems are a voice for the "judges" not the children. The "protective parent" will get an "incredibly over-flated" bill from the GAL that will cause them to go bankrupt and or then possibly arrested for not being able to pay it. It's all about bias and $$$ in Florida!
In Penna., GAL's are appointed by the Court to represent Children and the County pays the tab. I don't understand WHY these Parents are being charges for a GAL. I guess every State is different, but I wouldn't pay their fees either because the GAL's here don't really give a Sh*t, and usualy only support one side, not what's best for the kids ! They do what the Judge tells them to do, and custody/visitation decisions are made recklessly and irresponsibly !!
Be very careful with GAL's, especially in Florida. They often side with whoever has the best financial means to pay and not what is in the best interest of the child. I know a GAL who has a court documented history of violence yet is GAL to protect children.

I am not afraid to testify against him but they have to let me and this judge won't. If I thought there was a chance for me to talk sense to the judge, well, I wouldn't have needed this petition. It's a crazy idea, I know, and as the article points out it's dicey for your mother, but it could work. Ideally it would happen before a ruling was made so it would be harder to hold your mother in contempt.
If your mother maintains partial custody you can still do this even if the decision goes badly for you. I don't think you need both parents...just one.
But as always, seek legal counsel...this is a crazy idea and I know little about law.

We don't even know where he lives. His job travels. The way the laws are in FL, if he wins, he will leave with me and I will not see my mom again until I turn 18, if he lets me live that long, which I doubt.
OK, let's address the worst case scenario then. Your best bet will be to prove abuse as soon as it happens, in today's world this should be easy. Pin-hole cameras are dirt cheap, recording devices can be run for days non-stop. You have options.
If he is a drug user you can maybe get him declared unfit if the action is caught on camera. There are ways of addressing this outside the initial court decision.
As I have said, we do not know where he is to plant cameras or recording devices. Thank you though.

I would encourage the authorities to investigate this case carefully. The girl deserves a voice (the primary voice) in her own future; take her somewhere she can speak freely, confidentially without outside influence. Find out the truth of the matter, make sure she wrote this petition freely, and if she did, act on her wishes. Children are abused in so many ways in this country and being ripped out of a loving parent's arms and forced to a hostile environment, is tragically, one of the more common forms.
I have had to go see counselors, now two of them. Both have said I speak my own mind. My opinion of him is mine and not the mirror of my mom's. The first counselor I was forced to see, I have been seeing for 2 years now, only because she is part of my family now, saw this petition and knows I wrote it.
This is going to sound crazy Bryanna Lynn, but there is a way out if you can drag your feet until you are 16. I don't know if this is doable or not for you, and it could get your mother in trouble but consider this approach:

Of course, go find real legal counsel...but it's just an idea, a crazy idea.
Another thought: Find a safe place near your potential new location, after the first time he is abusive you could wait until he no longer suspects retaliation and sneak away and call the police. Pre-planning for the worst is going to be important in this scenario, you don't want to be trapped. Find people that can protect you, a place you can safely call the police in a case of abuse.
I don't know, maybe these aren't all good ideas--but I'm brainstorming. It's the only way I know to help!

Send complaints to the Judicial Qualifications Commission. They can only ignore complaints for so long.
