To ensure an objective, Constitutionally-based decision on the legality Obamacare,

Now that emails reveal that in March, 2010, then Solicitor General Elena Kagan was celebrating passage of the so-called "Affordable Care Act" with her fellow liberal activist Lawrence Tribe, it's ridiculously inappropriate for her to be involved in deciding the Constitutionality of this legislation. Even if she is capable of being unbiased, which is doubtful, her sitting in judgement in this case creates an appearance of impropriety that would render the decision a joke. Her history strongly suggests that she will blithely ignore her obvious conflict of interest. We need to shine a light on it, and force her, to at a minimum, explain why she should not recuse herself from what will be a monumental decision.
