Community Education Council 31 NOTICE of SPECIAL COMMITTEE & CALENDAR MEETING

PROPOSED RESOLUTION #72 - CEC 31 REQUESTS THAT NYS LEGISLATORS APPROVE AN AMENDMENT TO THE NYS EDUCATION LAW §3635 TO ENSURE YELLOW SCHOOL BUS SERVICE FOR ALL ELIGIBLE STATEN ISLAND 7th AND 8th GRADE STUDENTS:
WHEREAS, New York State Senate/Assembly Bill #A08683B/ #S6027B (amending the "like circumstances" clause in Education Law §3635) restored school bus service, but did not include ALL eligible 7th and 8th grade students as intended: and
WHEREAS, the New York City Department of Education (DoE) established a restoration list of middle schools on Staten Island authorized under the law to receive school bus service, excluding IS 63, PS/IS 861 and any future schools in District 31; and
WHEREAS, the NYC Department of Education and the Independent Budget Office reports affirm that Staten Island and parts of Queens require school bus service based on: a lack of adequate and accessible public transportation; a lack of safe pedestrian walkways; and students living the greatest distance from school; and
WHEREAS, Community Education Council 31 (CEC 31) members engaged in negotiations to restore school bus service for the excluded middle schools with the DoE Office of Pupil Transportation and were advised that the only way to grant service to these schools was legislatively; and therefore be it
RESOLVED, CEC 31 recognizing that time is of the essence, hereby requests that Staten Island legislative representatives take the necessary steps to advance the following proposed amendment to NYS Education Law Section 3635 to ensure school bus service for ALL grade 7 and 8 students in the designated geographic areas as quickly as possible:
NYS Education Law, Title V, Article 73, Part 3, Section 3635 (4):
4. The New York City school district established policy authorizing contract school bus service for grade 7 and 8 students in designated areas of New York City. These designated areas lack adequate and accessible public transportation and/or have unsafe or missing pedestrian pathways in areas where students live the greatest distance from school. Specifically these designated areas include Richmond County (Staten Island), in its entirety and previously identified sections of Queens County (Queens).
The New York City school district shall continue to provide contract school bus service for grade 7 and 8 students in Richmond County and the previously identified portions of Queens County, consistent with New York City Department of Education eligibility criteria.
New York City school district eligibility criteria shall remain unchanged and shall not preclude, prevent or adversely affect any student ineligible for school bus service, from submitting an individual "Hazard Variance" application for school bus service to the New York City Department of Education.
Notwithstanding any other provision of law, rule or regulation to the contrary, the New York City school district shall provide contracted school bus service to eligible students at ALL schools existing before or after September 1, 2010 located in Richmond County and the previously identified sections of Queens County, including 7th & 8th grade students.
This law shall take effect immediately.
