To amend title 18, United States Code, to provide to make the killing of a law enforcement officer an aggravating factor for the imposition of the death penalty.

In 2007 H.R. 3153: Death Penalty for Cop Killers Act of 2007 was introduced. This Bill was going to amend title 18, United States Code, to provide to make the killing of a law enforcement officer an aggravating factor for the imposition of the death penalty. It was sent to the House Judiciary, Subcommittee on Crime, Terrorism, and Homeland Security, but it never went any further and has since died.

There were 125 duty related deaths in 2009. That is the fewest line-of-duty deaths since 1959, when there were 108.

However, the number of officers shot and killed surged 26 percent, from 39 in 2008 to 49 in 2009. More than 30 percent of 2009's shooting fatalities—15 in all—occurred in five separate incidents in which more than one officer was gunned down by a single offender.

As of today (2-6-2010) There have been 7 Officers killed by Gun Fire, which is up 600% from last year at this time. What does this mean? That the criminals of today are more violent then ever before; and that if these individuals will shoot and kill a Peace Officer, they would not think twice in killing a citizen (you).

We need to act now, and we need to act fast to make sure that these violent criminals are dealt with accordingly. We need to get Congress to resubmit H.R. 3153 [110th]: Death Penalty for Cop Killers Act of 2007, and make sure it gets passed this time around. We as a Society want to be protected, but who is Protecting our Protectors? It's time to stand up and say; Enough is Enough!

July 24, 2007 Mr. GERLACH introduced the following bill; which was referred to the Committee on the Judiciary A BILL To amend title 18, United States Code, to provide to make the killing of a law enforcement officer an aggravating factor for the imposition of the death penalty. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Death Penalty for Cop Killers Act of 2007'.
SEC. 2. DEATH PENALTY FOR KILLING LAW ENFORCEMENT OFFICERS.
Section 3592(c) of title 18, United States Code, is amended by inserting after paragraph (16) the following:

(17) KILLING OF LAW ENFORCEMENT OFFICER- The defendant killed or attempted to kill a person who is authorized by law to engage in or supervise the prevention, detention, investigation, or prosecution of any criminal violation of law; or to arrest or prosecute an individual for any such violation'.
