Should Non-Citizens Who Overstay Their Visa After it Expires Face Civil & Criminal Penalties?

Argument in favor

Visa overstays are the main source of illegal immigration into the U.S. and it’s important to ensure that there is a deterrent and punishment for this form of illegal entry into the country. This is especially important in light of the fact that visa overstayers have been part of terror attacks, such as 9/11.

Yes, it’s the law. It was never enforced and now we having someone who will enforce what’s in the books.

👉👉Must have Robust laws to Enforce Immigration- or a VISA is worthless and simply an open Border Alternative to Those who don’t respect our countries Tax Payers.

Argument opposed

The punishments imposed by this bill are unnecessarily harsh, especially given that many visa overstayers eventually leave the U.S. on their own accord without the threat of punishment and overall visa overstay rates have been declining in recent years.

Civil paperwork violations deserve civil fines only. Do we give out criminal penalties for a parking ticket? No? Then this is just xenophobia. Also our constitution has a law against ridiculous fines. $500 a day is excessive.

Stop picking fights with people who cannot fight back. Why aren’t you going after all the drug lords, cartel enforcers, crazed gang members and human traffickers who were streaming through our border and who were the very justification for starting this war on immigrants? Too hard? Can’t find them? Were there ever any? This reminds me of the small township whose sole source of income was the Interstate highway exit ramp that fortuitously was in their territory. They issued speeding tickets to people who were exiting the highway. Were they speeding when they first hit Ramp? Sure. Was this a righteous thing to do? No. They were shut down when it was determined that much of the proceeds went to operate their own and highly illegal casino. Since you are obviously honorably interested in the “rule of law”, I think your time would be better spent protecting our country from the many severe, consequential, and Constitution-challenging misdemeanors that trump has made and is continuing to make to the detriment of our country- you know, that place referred to when you took your oath of office to do so defend. Time to act is running short, you have to act while there is still a country as we know it left to defend. Get your publican good ol’ bro’s together, chaw it out, and let’s get a cracking.

Dear conservatives, I know you are very Anxious about people being in this country that are not allowed by law. However, extremely ramping up penalties for over staying a visa will not discourage anybody. Draconian laws always fail to deter, rather it be crime or immigration. You need to look at the issue in GOOD FAITH and realize that this bill is not a solution and would only make things worse for everybody.

    Instead of penalizing people you should make it easier to achieve up dated green cards and also citizenship. Immigrants create jobs and spend money and pay taxes. When immigrants work they spend money which creates jobs. Maybe you should take a high school economics class and understand our Capitalism economy.

    I think this is an issue that can be better addressed... I don’t think criminalizing nor financial penalties are necessarily the best approach.... Overstaying visas is an issue - and there should be better enforcement of visa restrictions and people should be warned immediately on the day the visa expires and asked to leave - then if they have not either left, or organized a legal way to stay, after 30 days ....they must leave. Kindly, humanely escort them to an airport or border crossing and see them safely home. This is not the appropriate approach for asylum seekers, but for overstayers of visas- yes, visa visits are a privilege and those privileges and restrictions must be enforced.

    Let's spend our time & money on something like educating every child fairly & equally, helping adults get further education to better their lives, helping asylum seekers get compassionate, fair, honest help in their quest. Stop worrying about how to punish people & start figuring out how to help people. We will all have a better life when we promote the welfare of the poorest of us.

    For the first 100 years of this country’s existence there were no restrictions on or penalties for immigration to the United States. Contrast our change in attitude about immigrants where before we had no restrictions and now not only do we not welcome them, we work at keeping them out, and incarcerate them once they are here. What does this say about what we have become? It is definitely not for the better.

    There is regulation in Law handbook that if a petition is filed 45 days before to extend the respective visa category then it’s not an offense. Also according to the visa Type Nonimmigrant/Immigrant should be getting Approval of the entire period of stay in consecutive approvals or in whole for that visa Type if paper work is justified enough. Also medical urgencies needs to be taken care as well by this petition as emergency is an unwanted but unavoidable circumstance.

    Although a small fine might be acceptable, it would be more production to use the lager fines against the employer who keeps people employed past their worker visa has expired.
