Yes, they should be banned and charged with a crime. Anyone person knowingly involved with foreign agents who plan to ‘help’ a candidate get elected should also be charged with a crime and severely punished. This gets to the very heart of our democratic republic’s ability to be, well, Democratic. I am very concerned about the wanton in-your-face disregard of senior politicians, political appointees, and even congressional staffers to honor their oath’s to protect our country and to honor one of the more sacred founding principles of this country’s Constitution. We constantly see this being disregarded the administration, the trump’s supporters, and the trump’s enablers - as they all feel they are too entitled to be bound by such a ‘quaint’ principal of honoring their primary duties of office, to honor and protect our country and our Constitution.

Anyone who can be tied to interference in any US election should have all access barred permanently from this country. Those found to interfere with elections who are citizens should have their right to vote removed and all access to government agencies, officials, lobbyists or positions denied permanently and their names placed on cyber security lists.

Argument opposed

Sanctioning individuals who meddle in U.S. elections and preventing them from entering the country is only a weak deterrent given that most will never even attempt to come here.

They should be allowed to get as far as setting foot on U.S. soil, met IMMEDIATELY by law enforcement, taken into custody, held without bail, charged, and upon conviction receive a life sentence in solitary confinement in a maximum security U.S. prison.

What is Senate Bill S. 1328?

This bill — known as the DETER Act — would make foreign nationals seeking to engage in, or who have engaged in, improper interference in a U.S. election inadmissible. Improper interference in an election would defined as conduct that: 1) violates federal criminal, voting rights, or campaign finance law, or is under the direction of a foreign government; 2) interferes with any general or primary federal, state, or local election or caucus, including a candidate’s campaign or a ballot measure.

The bill’s full title is the Defending Elections against Trolls from Enemy Regimes (DETER) Act.

Dick Durbin (D-IL) reintroduced this bill from the 115th Congress to make "improper interference in U.S. elections" a violation of U.S. immigration law and thereby prevent foreign governments from exploiting U.S. immigration laws to advance their efforts to undermine U.S. democracy: 

“In 2016, Russia committed an act of cyber war against our country.  Unfortunately, Congress has done little to prevent future efforts by Russia or others to influence and disrupt the 2020 elections. The bipartisan DETER Act would prohibit foreigners who improperly interfere in our elections from coming to the United States to further their schemes, and bar them from entering our country in the future.  Congress has a duty to act and protect one of the main pillars of our democracy – fair and credible elections.” 

Last Congress, Sen. Durbin introduced this bill to to deter foreign regimes from interfering in American elections by barring individuals who meddle from admission to the U.S.:

“In 2016, Russia committed an act of cyber war against our country and Congress has a responsibility to take immediate action to prevent Russia’s efforts to influence and disrupt the 2018 elections. The bipartisan DETER Act would prohibit foreigners who improperly interfere in our elections from coming to the United States to further their schemes, and bar them from entering our country in the future.”

Original cosponsor Sen. Lindsey Graham (R-SC) added:

“As we saw in the 2016 elections, Vladimir Putin’s Russia is attempting to strike at the very heart of the democratic values, freedoms, and liberty all Americans hold dear. By barring foreigners who improperly interfere in our elections from coming to the United States, the DETER Act sends a message to hostile nations across the world that the United States will not tolerate foreign interference in our elections.”

This bill has three bipartisan Senate cosponsors, including two Republicans and one Democrat, in the 116th Congress. In the 115th Congress, it passed the Senate  Judiciary Committee with the support of three bipartisan Senate cosponsors (two Republicans and one Democrat) but didn't receive a full Senate vote.

This bill passed the Senate by unanimous consent in June 2019, but hasn't yet been considered in the House.


Of Note: Special counsel Robert Mueller's indictment of Russians who traveled to the U.S. with the explicit purpose of learning more about American political and electoral processes and how they could interfere with those processes described how two individuals gathered intelligence during a three-week trip in June 2014. In the indictment, the special counsel described how these individuals "falsely claimed they were traveling for personal reasons" during a trip through Nevada, California, New Mexico, Colorado, Illinois, Michigan, Louisiana, Texas, and New York. On that trip, they collected intelligence to inform the Russian Internet Research Agency's operations.

The U.S. intelligence community has indicated that Russia, China, and Iran are seeking to influence the 2020 presidential election.

    Foriegn Nationals who interfere in our elections should not be allowed to enter the US, with the exception of testifying to their crimes in a court or an impeachment hearing. Also, the new postmaster (aka: mega donor) general that tRump appointed on Friday just reassigned 23 postal executives! He also informed states that they will need to pay 55-cent postage to mail ballots to voters (rather than 20-cents the bulk rate). This after he cut overtime, which increased the time mail needs to reach its destination. THIS IS INTERFERENCE IN OUR ELECTIONS!!!

    Foreign nationals engaging in US elections should be deported, and those interfering in any way should be criminally charged and fined then deported! Anyone engaging in financial transactions (both sender & receiver) should also be punished. And US citizens colluding with them should be sentenced to prison as traitors.

    Yes, and those who are already here should also be arrested and tried. We need to take real election security very seriously. I doubt most of those Russians who were accused from 2016 will ever come to this country, but we should still be prepared if/when they do. And if anybody from other countries tries to interfere they should also be pursued. Any Americans who conspire or collude with foreign interests to interfere in our election should not be free of consequences.

    Not sure that “entering” the US is the problem. Most people who are planning to be a detriment to our security, both financial systems & election concerns do not have to BE in the country they are hacking. However, I agree with not letting them in unless they are in handcuffs and to testify

    Foreign nationals interfering or attempting to interfere with our elections should never be permitted to enter our country. The main argument against such legislation seems to be that it’s not really an effective or practical solution and it’s just smoke and mirrors. I actually agree that it wouldn’t be much of a practical deterrent. Nevertheless, I think this legislative action should be taken even if it mainly symbolic. I assume that such actions are already the subject of federal criminal laws and investigations.

I am also unhappy that the proposed amendment mentioned in the linked article didn’t make it into the Intelligence committee’s bill.     Of course! This just makes sense, so I'm sure Republicans won't vote for it! They know those hostile foreign powers interfering in our elections favor them, and they don't care if they flout the will of the American people and become friendly with hostile foreign powers, so long as these keep them in power by their cheating and hostile acts!

    All of this interference could be delt with by putting the voter rolls on the blockchain and issuing voter ID. The technology Visa and MasterCard use to keep track of transactions could be used also. Voter fraud in this day and age is simply unforgivable. The only party standing in the way eliminating voter fraud is the party of death, lawlessness, segregation, and destruction or better known as the Democrats. All the foreign interference is nothing compared to what the Democrats do.
