The POTUS has overreached his authority on this issue. If he is allowed to make new laws himself then why do we have the other branches of government? Because he does not have this authority.

Instead of using funds for reforms to better America and its people, funds are used to sue the president. A progressing vendetta against his leadership continues as many dedicate significant amounts of time to take him down. Let's be humane, especially to those who've spent so much time contributing to our Country. Plus, if Congress doesn't like it, they should just pass their own bill. Gridlock is no answer to this important issue.

What is House Bill H. Res. 11?

This bill authorizes the Speaker of the House of Representatives to initiate a lawsuit against the President, the head of a department or agency, or any executive branch employee for failing to comply with their legal duties as they relate to immigration laws.


Specifically, the failure to adhere to the Constitution and U.S. laws specific to "illegal aliens, undocumented immigrants, or non-American citizens." The Speaker would be directed to notify the House of a decision to initiate or intervene in a civil action against members of the executive branch.


The Office of the General Counsel of the House would represent the House in court if a trial were to happen. The House would also be authorized to employ outside counsel or other experts.

President Obama announced in late November of 2014 that his administration would grant protection from deportation to roughly 4 million undocumented immigrants. Many have questioned the legality of his plan, and indeed the President himself has expressed doubts over his ability to influence immigration policy through executive action.


Republicans have not only threatened a lawsuit over what they view as overreach by the executive branch, but they have discussed refusing to fund the implementation of the executive orders as well. Opponents have also cited two Supreme Court verdicts that bolstered the authority of Congress on immigration issues. Kleindienst v. Mandel affirmed that Congress can pass laws empowering the Attorney General to refuse someone’s entry into the U.S. In Fiallo v. Bell, the Supreme Court ruled that “over no conceivable subject is the legislative power of Congress more complete than it is over the admission of aliens.”


Keep in mind, deferring deportation for undocumented immigrants who have lived in the U.S. for over five years and have children that are legal U.S. residents is similar to previous presidential amnesties.

    Illegal aliens are NOT immigrants. They are criminals. Criminals should not be rewarded. If I murder someone but then behave for 5-20 years, am I no longer a criminal/murderer? It IS the same. If they are criminals and illegal ALIENS then so are their offsprings. They should have thought about that BEFOREHAND committing a crime. I am a LEGAL IMMIGRANT and I so HATE our country being infiltrated by these criminals. POTUS may not use his "power" against the constitution OR against the laws of the U.S. Additionally, this country was set up to MINIMIZE Federal interference with affairs of the states. SUE him and WIN! He is setting a precedence for future POTUS and political abuses. We MUST remain a democracy, a Christian based nation (although welcoming all that mean no harm and come here legally) and RESIST any trend toward socialism, dictatorship or anything away from the God blessed free democracy that we are trying to hold on to.

    The lawsuit was Boehner's unfortunately dead on arrival alternative to an equally futile attempt he was unwilling to mount that would have presented Articles of Impeachment. And why, with two Republican Houses of Congress, the President's appointed Attorney General could still stiffarm the idea of a Special Prosecutor points up a flaw in letting the pooper scooping AJ be executive appointed ever again.
