house Bill H.R. 5232

Do Tax Deductions for Advertising Junk Food to Kids Need to be Eliminated?

Argument in favor

Companies that sell unhealthy food and spend large amounts of money advertising that food to young children shouldn’t be able to write off those marketing expenses on their taxes. The National Academy of Medicine is qualified to determine what brands should be punished.

Childhood obesity stresses the healthcare system in cost and resources. This, coupled with tax incentives to maintain youth's poor nutrition, unjustly extorts children.

Argument opposed

This bill would allow unelected government officials to decide what companies’ foods are of poor nutritional quality and punish them by taking away marketing tax deductions available to all other businesses. That’s unfair, and sets a precedent for selective enforcement of tax laws.

You can tell this is coming from a Democrat because it's about taking more money from someone. Dear politicians, this is a parent issue. It is up to the parents and not the children as to what products are bought. As we all know this has nothing to do with health or children, it's about government taking more money and it will not end with just unhealthy foods. Like any law that passes congress this too can be added to over time but will be very hard to get rid of. How long until they decide that your religious beliefs are unhealthy and you lose the deduction for giving to your church? How long until they just decide your unhealthy for your children and they just take them? Remember one very important thing, you only have a right to due process in a criminal matter and most every action the federal government takes is called a civil action. They do it that way because they don't have to prove anything but you have to sue them to reverse the action and that can take years and lots of money.

If this is about advertising to young people and 'choosing' winners and losers for marketing deductions, it is not the government's place to make these decisions

What is House Bill H.R. 5232?

This bill would deny tax deductions for advertising or marketing directed at children age 14 or under for food of poor nutritional quality or a brand that’s mainly associated with food of poor nutritional quality.

The Treasury Dept. would be required to enter into a contract with the National Academy of Medicine to develop procedures to evaluate and identify food of poor nutritional quality and brands primarily associated with such food.

Annual funding for the Fresh Fruit and Vegetable Program under the National School Lunch Act would be authorized by this bill to be transferred from the Treasury.

Impact

Businesses advertising unhealthy foods to kids under age 14; the National Academy of Medicine; and the Treasury Dept.

Cost of House Bill H.R. 5232

A CBO cost estimate is unavailable.

More Information

In-Depth: Sponsoring Rep. Rosa DeLauro (D-CT) introduced this bill to help improve the diet of American children and reduce obesity by cutting off tax exemptions for advertising unhealthy foods to kids:

“The U.S. is in the midst of a dual epidemic of obesity and diabetes, and we need to do something to stop it… We must do everything we can to ensure that our kids can grow up healthy and we can start with enacting the Stop Subsidizing Childhood Obesity Act to help them make the right nutritional choices.”

This legislation has the support of 10 House cosponsors, all of whom are Democrats. The bill’s sponsors note that a 2012 report by the Federal Trade Commission found that nearly $2 billion is spent annually marketing food to children.

I am SICK AND TIRED of Uncle Sam trying to MICROMANAGE every aspect of our lives! This is NOT the business of the federal government! Children should be taught about nutrition by their parents, their schools, and their doctors. And businesses shouldn't be manipulated like this to facilitate your desire to control the people you profess to work for! When I was a child, recycling hadn't yet caught on big, but kids could gather up soda pop bottles and turn them in for the deposit. Some of us were lucky enough to also get a small allowance from our parents. I remember taking my little bit of saved up money to go and buy a box of dark brown sugar, because I just loved those dark little lumps in it! My parents knew nothing about it. Kids will find a way to get such "treats," whether you advertise them or not! I'm flabbergasted by the hypocrisy of people who worry about our children eating junk food, but don't mind Monsanto poisoning our food, and who are determined to force GMOs down our throats! Just because scientists like to tinker with the building blocks of life, that doesn't necessarily mean that it's a good idea! What it DOES mean is that THEY ARE USING US AS HUMAN GUINEA PIGS AND THEY HAVE NO IDEA WHAT THE LONG RANGE CONSEQUENCES WILL BE! Modern, conventional agriculture is DEPLETING OUR SOIL! HEALTHY SOIL IS FULL OF BENEFICIAL ORGANISMS, AND THEY ARE BEING DESTROYED BY ALL OF THE PESTICIDES, HERBICIDES, AND OTHER CHEMICALS BEING APPLIED BY BIG AG! You should be promoting organic farming and ranching, if you care about our environment, our health, and what we eat! I prefer REAL, UNCONTAMINATED, ORGANICALLY PRODUCED FOOD! I did my best to instill good eating habits in my children, but even I enjoy eating a little bit of what I would normally consider "garbage" now and then. Michelle Obama tried forcing her views on what constitutes a healthy diet on our schools. You liberals should have gotten the message then that you have no business trying to dictate what we should eat! Also, I'd appreciate it very much if you'd QUIT SUPPORTING THE PRODUCTION OF GMOs WITH TAXPAYERS' DOLLARS and PLEASE PUT A STOP TO THE KILLING OF OUR BEES AND OTHER POLLINATORS THAT SO MANY OF OUR CROPS DEPEND ON! I like what Countable member SherryTX said: "Last I checked, advertising was a business expense and therefore tax deductible. Exceptions should not be made for the type of product one advertises. How about stopping the purchase of junk food with food stamps? Afraid of making the recipients mad?"

It is the responsibility of parents to decide which foods their children should eat, not the government. Companies should not be punished for one of their basic functions: marketing their products to people that can or are attracted to buying their products. To punish this is an unfair indictment against capitalism when other hands are at play that can reach the solutions that all of us want to achieve (reducing childhood obesity, etc.)

More of an economic stand point but these deductions help businesses grow and employ more workers which helps the economy. It is up to parents to teach their children what to eat and how to eat healthy. Schools should also provide education on the matter. But we don't need the government meddling in the economy because they disagree with the health status of the product

Ridiculous! Mothers and Dads are the best to combat bad choices not advertising cost deductions. Capitalism will work as parents expose children towards good eating habits. It's also my belief parents are at fault in seeking foods they enjoy and thus infecting their children.

While I agree with the goal of this bill, I cannot support it. The standard of poor nutrition is a moving target. Not so long ago, eggs were considered harmful, fat was to be avoided, much w, it's just the opposite. Until we can get a better understanding of nutrition and create measurable standards, this bill cannot provide objective enforcement.

This is just ignoring the real issue which is parents doing a crappy job raising their children. Let parents manage their kids. Just another example of government trying to take the place of parents.

To begin with, advertising should not be permitted for a tax deduction. It is a business expense. Having said this, children's eating habits are the responsibility of their parents/guardians. The Government should not dictate what we can eat or not.

It is time for the "Government" ( ie: unelected, unacceptable bureaucrats who "know better) to get out of our daily lives. If we continue at this rate, and we will if Hillary is elected, we will soon be something like the books "1984" or "Atlas Shrugged". We need less, not more Government interference in our lives!!!!
