Argument in favor
China needs to be punished for continuing to allow its citizens and companies to violate U.S. intellectual property rights. Imposing duties on Chinese products in an amount equal to revenue losses suffered by U.S. intellectual property holders is a strong deterrent.

This isn't just about intellectual property. It's about leveling the playing field. The Chinese charge us a 35% tariff on goods that we want to sell in China. Yet we don't charge them any tariff for them to sell their goods here. And you wonder why we don't have jobs for the middle class anymore?

"We have agreed that neither the U.S. or the Chinese government will conduct or knowingly support cyber-enabled theft of intellectual property, including trade secrets or other confidential business information for commercial advantage. In addition, we'll work together and with other nations to promote international rules of the road for appropriate conduct in cyberspace." [cnn.com]

I had a friend that had his project entirely ripped off by a Chinese company, he was faced with the inability to act. I'm not a fan of intellectual property, but this seems like it might be a reasonable step to help solve his problem.
Argument opposed
Not only would imposing these duties against Chinese goods likely lead to China imposing similar duties on American products, but estimating losses and distributing compensation to U.S. intellectual property holders would be very complicated.

I am in favor of holding China accountable; however, in the current situation and our utter reliance on the Chinese economy would make these actions incredibly hostile and raise tensions to new levels. Until we begin to rely on our own workforce, our own economy, and begin to pay back the debt owned by China I would say put a lid on it. If anything get permission from China, whom supposedly is held accountable to this cyber deal created months ago, to go after those stealing intellectual property. I find it terrible that Americans are having their intellectual property stolen, but we can't be selective. You want to impose a duty tariff do it across the board. Since that won't happen, get our house in order then go after them.

Absolutely NO! This would cause Obama to create a new DOJ division. Thousands of new lawyers would be hired with extra staff. Government grows to a point where any money collected from China would be pennies as compared with cost of collection. And then there's the action that China may take in retribution. Nightmares!

Before we do much against China, we have to get out from under their jack booted heals and out our national debt, which they own the most of. We also have to be ready to take on their military bases. Then we can approach them from a position of strength, and fear of retaliation.

I like the idea in principle, but the fact is we are in deep financial debt to China right now. I was once told that when your head is in the lions mouth you ease it out. So biting the hand that feeds us (at least for the time being) might give a since of vindication or satisfaction but it's short sighted at best and downright stupid at worst.

With the world, including both the US and China teetering on the brink of financial collapse , an action like this while morally right could have significant negative unintended consequences for everyone.
Here's an idea. Let's just stop doing business with China! Why should our stocks be affected with what's going on with a Communist country? It never used to!
Any thing that will make China a fair trad partner should be done.
Theft can't be ignored. Retribution is called for. Is China goods become too expensive we'll make them
