Should Congress Have to Approve a National Emergency Declaration Before it Takes Effect?

Argument in favor

Presidents have too much power when they declare national emergencies and as a result, they should only be allowed to declare them with Congress’s agreement. This bill would ensure that presidents can’t abuse national emergency declarations to make unilateral policy decisions and subvert the legislature’s checks and balances.

Argument opposed

The broad authorities given to presidents under national emergencies were granted by Congress in recognition of the fact that such situations may require the government to respond more quickly than is possible under normal legislative processes, so tying the president’s hands is counterproductive.

No as by it’s definition it’s a emergency and one of the presidential powers given to him by the constitution if you wait for the Congress any emergency could turn into a war by the time they got around to it and the only reason the congress is now upset they could not over rule the presidential veto

If we allow Congress to have a say whenever there is a national emergency needed, firstly, we would probably be nuked before Congress could agree on something, and secondly, it would turn national emergencies into partisan issues. Let’s be real, we also all know this is a dig at Trump. There is an emergency at the border!

    Absolutely. A National Emergency obviously effects the entire Nation and therefore should not be the unilateral decision of one individual or faction of the government. This could lead to tremendous abuse for partisan reasons as seen with the recent declaration, and should not be allowed to happen again.

    It’s called checks and balances! National emergencies shouldn’t be allowed to move forward without congressional approval. The President has too much power in these kinds of situations as we’ve seen with this administration which has completely bypassed Congress to declare a non-emergency emergency at the border. Under this bill, a Democratic Congress would have to approve any new emergency declaration within 60 days in order for it to move forward, similar to the War Powers Resolution.
