Supreme Court Orders Biden Admin to Reinstate Trump Era Remain in Mexico Policy

What’s the story?
- The Supreme Court on Tuesday rejected an appeal by the Biden administration to temporarily block a lower court’s order that it reinstate the Trump era Migrant Protection Protocols (aka the “Remain in Mexico” policy). The case ― known as Biden v. Texas ― will now make its way through the appeals process on the merits.
- The Trump era policy required that migrants from third countries who seek to apply for asylum in the U.S. remain in Mexico while their application is processed prior to their hearing, rather than being allowed to enter and remain in the U.S. while it’s adjudicated.
- In a 6-3 ruling along ideological lines, the Court’s conservatives held that the Biden administration “failed to show a likelihood of success on the claim that the memorandum rescinding the Migrant Protection Protocols was not arbitrary and capricious.”
- That means the Biden administration appears unlikely to be able to prove that it abided by proper rulemaking procedures under the Administrative Procedures Act (APA) to justify its executive action to end the Remain in Mexico Policy.
- The decision is similar to one the Supreme Court made in June 2020, when it found the Trump administration’s decision to end the Obama administration’s Deferred Action for Childhood Arrivals (DACA) program to have violated the “arbitrary and capricious” standard under the APA.
- The ruling comes amid a surge of illegal immigration at the Southern border, where apprehensions of unauthorized immigrants have been at 21-year highs for the last five months. It remains to be seen whether the reinstatement of the Remain in Mexico Policy deters migrants from crossing the border illegally.

I think this is the correct way to deal with our Southern border.
Why do we want all the unvaccinated in the country?
Thankful for the Supreme Courts ruling for the policy that requires that migrants from third countries who seek to apply for asylum in the U.S. remain in Mexico while their application is processed prior to their hearing, rather than being allowed to enter and remain in the U.S. while it’s adjudicated. Any entity that validates whether a person has the right to enter checks credentials before letting a person enter. Even some theaters and restaurants and other places are doing the same by not allowing people to enter without proof of Covid vaccination. If they can do this to prevent people from entering their place of business - then the USA should halt entry to the USA without credentials - and vaccinations!

Mexico is not a good place to warehouse people in need of asylum.
Remain in Mexico policy is one of the few effective tools in stemming the tide of record illegal crossings. It is very concerning that in the midst of an out of control situation the Biden admin tried to cancel the policy which would clearly make things worse

Amen! It’s about time something starts to happen down there! Under Biden, our borders are completely unsafe- there are drugs and terrorists coming over, not to mention the illegal flow of immigrants who aren’t even being caught and released. Everything about what Biden has done is bad- bad for the country, bad for the residents and citizens, and bad for the immigrants themselves. It is unsafe for all people, but Biden and the Democrats clearly don’t care about people, only their political agenda and attempting a corrupt takeover of our Democratic systems and Republic. I hate everything about the Biden administration. I didn’t think I could hate a President more than Obama, but I gotta say, Biden may just be the worst President of all time and take that title from Obama…
We need Congress to step up and make clear that this policy is inhumane and unacceptable! It is not well supported by current law, and was NEVER the US policy before the Trump administration, should NEVER have been US policy, and should never BE Us policy! Unless my reading is faulty, it also violates a couple of treaties that have higher priority than US law. End it. Now!
this comes down to whether one agrees or not with an open border, especially in light of the virus problem. As it is, it is easier to get in across the border with no paperwork or virus test than it is to get out of Afghanistan with a much more immediate threat. Instead of squabbling over this, perhaps they should in congress attempt to fix these problems with immigration reform - but it seems they'd rather keep it as a problem to use as a future election issue for campaign funds than actually do anything about it...
Looks like Supreme Court needs some fixin’. Let’s see it took 15 - 20 months for the court to rule on issues involving the trump - and it took something like 15 - 20 minutes to rule that Biden could not reverse an executive order of the trump. … … … The court’s actions are making a very clear case for impeaching some justices because they were placed on a strictly partisan basis or to expand the court with liberal justices to bring it back into some sort of balance. … … … This is important for the future because our country will be facing some critical challenges which will require changes, restructuring and strategic risk taking. We cannot afford to be throttled by the court or politicians focused on protecting ‘what used to be’ instead of preparing for ‘what is coming’. … … … I have said it before and will say it again; If our country was throttled by political faction’s and the kind conservatism that we have in practice today, we would have protected our very profitable corporate interests to keep equipping the Nazi war machine - and we would all be speaking German today.

This is how it should be. There is way more at issue. Biden’s incompetence and weakness has emboldened every enemy. The porous southern boarder brings in COVID, terrorist, drugs, sex trafficking into our country.

The Supreme Court acted way too long to demand Trump's "Stay in Mexico." They should have acted on that as soon as the Court knew what Biden and his minions had done on day one of opening the Border!!! Illegals are now spread throughout the United States and they have not been checked for COVID virus; thus, spreading the virus throughout. Not only this but havens, safe houses, set up for illegals and American Tax Payers footing the bill is totally unacceptable. One such safe house is located in Scottsdale, AZ. Not only are they being housed but fed on tax dollars, Our tax dollars that are not earmarked for such atrocities. Am I angry? You darn bet I am. Check out "Endeavors.org" - a San Antonio nonprofit tied to the Biden administration. They received, as reported, "$87 million no-bid contract in March to clothe and shelter illegal migrants. They then received another contract for $530 million shortly thereafter." Are you awake yet?
The judicial branch has no right to be trying to limit the executive branch for their conservative agenda. We need to expand the Supreme Court now!

It’s amazing how slow our federal court systems are! This case should have been on the Supreme Court docket within a month of Biden taking office. Look how many thousands of illegals have been allowed into OUR NATION by this embarrassing president and his anti American administration. Now they’re here. Every murder, every assault, every rape, everything that any of these criminals cause, the blood is on their hands!
