Lynn's Remains were Missing for 31 Years.
I want Lynn Lemke's entire case file 89-019468 changed from protected under Government Code 6354(f) to Public Knowledge under Calif. Public Records Act: Gov't Code §6250-6268
These records were not classified as such when they were initially released under CA Penal Code 11075-11081. In addition, I have requested these documents, with the case number available four times prior. In person, via phone with Sergeant Doyle, via a 911 call request, and finally via email asking to search microfilm. I had been told the files and all evidence were destroyed on three occasions. When I spoke with the records supervisor on the 4th request, she stated she found said records on microfilm.
Furthermore that the reason I was told they were destroyed was that they had no case number, which is false.
There is an exemption to this 6354(f)
**when disclosure of information is not impeding an ongoing investigation or related investigation, and nor would endanger the safety of a person or witness involved in the case. Both parties in the investigation have passed away. The case is closed and no criminal charges were filed.**
Information is in the public interest and will contribute significantly to the public’s understanding of how Lynn came to her disposition. The release will benefit the remaining family and friends of Lynn Lemke. The benefit to release documents to the public, outweigh the benefit of withholding.
