This week Donald Trump declared a national emergency in order to reallocate money from the military to build a border wall on the United States' border with Mexico. Trump declared the national emergency for border wall funding after Congressional negotiations failed to net him the funding he desired. In response, Trump manufactured a crisis, declaring a national emergency where none exists. He claims that people and drugs are pouring over the border in record numbers, but in fact, immigration is down from years prior, and most drugs don't enter the country illegally, but through smuggling at legal ports of entry. Quite simply, there is no crisis at the border, and Donald Trump is trying to fabricate one to secure a policy accomplishment that he couldn't achieve through standard negotiations.

While the construction of a border wall is troubling for a variety of reasons, even more troubling is the precedence that Trump's declaration of a national emergency sets for future presidents. National emergency powers suspend normal rules of order and grant the president special authority to create policy. National emergency procedures were created to help presidents act quickly in times of dire emergencies, when relying on Congress would create national security issues. But by claiming that there is a national emergency, when one does not exist, Trump is setting a precedent that would allow future presidents to declare national emergencies to achieve any policy priority of their's that is unsatisfied by Congress.

This is not how our legislative process is supposed to work. Congress should hold the power to propose and pass laws, while the President should determine how laws are enforced. If we let Trump get away with declaring this national emergency, the Executive Branch will have successfully usurped the Legislative Branch and will be able to pass any legislation it fancies in the future. This is particularly dangerous because the cooperative legislative process helps make sure all voices and interests are heard and prevents violent confrontations over policy. In a world where the President determines policy outcomes, national consensus will be more difficult to build, and resentment over policy outcomes will grow.

We must stop Trump's fabricated national emergency. Congress, you have the power to overturn his declaration, we are counting on you to assert yourself as a co-equal branch of government and stop this madness.
