Crown Counsel and the Honourable sentencing Judge in the provincial court of British Columbia, Canada

This petition requests that, if either or both of the Bickerdikes is convicted of animal cruelty in relation to Mr. Tibbs, Shiva, Chompers, and/or Bubba, Crown Counsel recommend, and the judge apply, the maximum sentence available for the animal cruelty charge(s). The petition further requests that, if convicted, the Bickerdikes be prohibited from owning, having the custody or control of, or residing in the same premises as an animal or a bird for the rest of their lives. Finally, if one or both of the Bickerdikes is convicted, the petition requests that the court order the person(s) to pay to the SPCA the amount expended on behalf of the Bickerdikes’ animals.

A German shepherd named Shiva (pictured), two poodles (Chompers and Mr. Tibbs) and a brown tabby cat (Bubba) were owned by Dave and Beverly Bickerdike of Metchosin, British Columbia. According to the British Columbia Society for the Prevention of Cruelty to Animals (BC SPCA), as a result of complaints from the public, an investigation was undertaken. The Bickerdikes' animals were seized by the BC SPCA, as they were all in distress: "'All of the animals required immediate veterinary treatment for untreated problems ranging from serious mobility issues, pain management, severe periodontal disease and skin issues,' says SPCA constable Lynsay Bailey. The health of one of the poodles, Mr. Tibbs, deteriorated rapidly despite intervention and he had to be humanely euthanized on the advice of a veterinarian." Shiva, Chompers, and Bubba were cared for at the Victoria SPCA, where they received veterinary care and were subsequently adopted into new loving homes.

To compound matters in this case, the Bickerdikes failed to comply with the SPCA's repeated requests to view the animals, so SPCA constables were forced to obtain a search warrant to inspect the premises and ultimately seize the animals. Furthermore, the SPCA says it has responded to several complaints in the past involving animals owned by the family.

According to the BC SPCA, if convicted, the Bickerdikes face up to a maximum of five years in jail, a fine of up to $75,000 and up to a lifetime prohibition on owning or having custody of animals.
