On Christmas eve, Ezekiel Gilbert hired an escort. She met with him
but did not have sex with him, and refused to return his money. As she
turned to leave, Gilbert shot her in the neck, leaving her paralyzed.
Seven months later, she died of complications from the shooting.Texas
law allows people "to use deadly
force to recover property during a nighttime theft." The attorney said
that because Gilbert
expected sex from the escort, her refusal to refund his $150 was
considered theft. (Never mind that prostitution was an illegal act.)
With the verdict, a man guilty of murder walks free, while his victim, a
23-year-old woman, is dead. A law intended to protect citizens from
violent crime was used to get a murderer off. Texas lawmakers need to
clarify the law so this never happens again.
