Legislative Assembly of Victoria, Victoria Premier Denis Napthine, Monash Council, Peter Walsh - Minister

We the undersigned demand a rethink on the whole BSL issue.

We respectfully ask that the VIC State Government urgently amend the Domestic Animals Act 1994 and in particular sections pertaining to restricted breed dogs. 

Genetic tests must be allowed to provide proof of breed.

Anyone responsible for determining a dog is of a particular breed is required to hold suitable qualifications to be able to make such determinations. 

We request that if a dog is determined to be of a restricted breed, further behavioural tests are to be conducted by a suitably qualified, independent, animal behaviourist.

Please stop wasting tax payers’ dollars implementing and defending the current law that does nothing whatsoever to prevent dog attacks and allows the murder of innocent animals based on completely unscientific principles.

We are tired of living and worrying about whether our own dog will be the next innocent family pet to be seized just because it looks like a restricted or banned breed.

As it currently stands BREED SPECIFIC LEGISLATION ( BSL) does not allow for a simple blood or swab test to be used to help prove a dogs genetic makeup or breed.

Minister Peter Walsh the man who is believed to be behind the wording in the Legislation has stated on radio that :" BSL is to remove all dogs that LOOK dangerous"..

So, all families with Staffy looking dogs, especially in the City of Monash could face the prospect one day of losing their own dog to BSL.

The Monash City Council have the power to free Kerser for example who is currently on a 14 day reprieve from his death sentence.

His crime? ..he looks like a PitBull.

Why Mayor and Councillors do you want to kill an innocent puppy?

Kerser has not broken any law. Let him go free and back to his family.

Allow Kerser to have the simple blood or swab test so that you can see that this dog is not a restricted breed.

Premier Denis Napthine has the "power" to end BSL in Victoria.

He has the "power" to allow blood or swab tests into Legislation immediately.

START the change today. Ban deeds and not breeds.

Judge all acts on their own merit.

Are you worried that your own dog might end up an innocent victim one day?

Well ..you should be!

A classic example of BSL gone wrong is - LENNOX. The poor dog that was seized in Northern Ireland. Lennox was not a restricted breed of dog. He had committed no crime, and yet they seized him, kept him a prisoner for a few years then killed him. Lennox will never be forgotten by the thousands of supporters he has worldwide. RIP dear Lennox xox

Closer to home here in Australia we have quite a few dogs that have been killed due  to BSL.

RIP Bear and Kooda for example.

Dougie, Rocket and Kerser are all fighting for their lives right now.

KERSER has had a 14 day repreive from deathrow.

Monash Council seized this puppy last December 2012. Kerser has committed no crime other than to be deemed a restricted breed, and he wasnt registered at the time of seizure.

RULING FROM VCAT

HEAD: "I was satisfied that from every angle the shape of Kerser's head was that of a blunt wedge and compliant in this respect with the standard."

MUZZLE: "Although Ms Harwood gave evidence that the muzzle was not broad and deep because the skull was too long for this to be the case, I did not agree with her observations."

EYES: "I found the eyes to be round. I did not agree with Ms Harwood's evidence that the eyes were of "oriental appearance".

NECK: "I disagreed with the observations of Ms Harwood that Kerser has a thick short neck. I found the neck to be of moderate length with significant strength."

BODY: "My observations of Kerser were of a powerfully built dog with a deep chest of moderate width. I disagreed with the evidence given by Ms Harwood that he was long in leg and slight in body."

CONCLUSION: "I am satisfied that Kerser readily meets the description of a pit bull in the standard ... He may not be a perfect example of a pit bull. 

However such a dog probably does not exist."— Deputy President Heather Lambrick, Victorian Civil and Administrative Tribunal
