Air Liquide

On February 9, 2013 Michael Smith was life flighted to UTMB Burn Center in Galveston, TX following an explosion at  Air Liquide. An explosion which occurred in a mixing room at the Air Liquide cylinder plant claimed the life of Javier Ortiz and left Michael Smith fighting for his. Now after nearly eight weeks of fighting and years of rehabilitation ahead of him, Mike is now being considered a non-active employee, and after almost 11 years of employment, Air Liquide has sent notice that in five weeks they will be terminating Mike and with that, he will lose all of his benefits including medical and life insurance. His wife Robyn suffers from a heart condition and his 4 year old daughter Payton has Autoimmune Neutropenia, and anyone that has sought out private health insurance knows that with the pre-existing conditions Robyn & Payton suffer from there will be little or no luck finding any affordable insurance, if any at all. Because the family is being compensated some of Mikes wages, they become ineligible under the guidelines for any state aid insurance. The Cobra premium is an unaffordable $1500.00 per month, and they don’t qualify for SS disability because they receive workers comp so in return they’re not eligible for Medicare or Medicaid.

Within the the hour of Mike’s arrival to the hospital, Air Liquide had a representative at the hospital & had already begun the workers comp process. This all seemed great at the time, as though this company actually felt remorse for the horrific event that left one man dead and another fighting for his life. In fact this was not a good intention gesture on Air Liquides part at all; this was a strategic move to prevent anyone from being able to sue the company for damages caused by the explosion. It turns out you cannot sue a company if given workers comp. Too bad the family wasn’t provided with this information from the beginning!

From a business stand point, I understand they have every legal right to do this. But putting business aside, this is just wrong! How can this company who is responsible for the injuries Mike sustained, now, without a second thought eliminate the health insurance his family so desperately relies upon? We as supporters of this wonderful family should exercise our right to the freedom of speech and let Air Liquide know how wrong this is, and even from a business stand point completely unethical! PLEASE JOIN OUR CAUSE!  Maybe we can help, maybe it won’t make a difference at all, but regardless of the outcome we need to stand up and stand together and be an incredibly loud voice on behalf of Mike, Robyn, Karlee, and Payton. They need to be heard and Air Liquid needs to know that this family cannot lose their health insurance!
