PLEDGE: DIGNITY FOR MADIBA - STOP HATE SPEECH AGAINST OLD PRESIDENT NELSON MANDELA
Dear Sir/ madam
Re: Promotion of Hate Speech and Racial Hate against old president Nelson Mandela.
I wish to express my disgust and concern about the the fact that Sunette Bridges actively promotes racial hate against old president Nelson Mandela on her facebook page (as per https://www.facebook.com/SunetteBridges?ref=ts&fref=ts ). Referring to Mr. Mandela's recent hospitalisation, her comment that "I am not impressed by the fact that this man made god may highjack our Savior's weekend" is absolutely shocking and extremely offensive (original: "Ek is gladnie opgewonde oor die vooruitsig dat hierdie mensgemaakte god dalkies ons Verlosser se Paasnaweek gaan kaap nie! Sx").
Subsequent comments by her followers, e.g. "Let the mo*er die we BOERE will not miss him because what did that rubber neck do for us whites absolutely fuck all so let him die I will not miss him I will go sh*t on his grave" is a transgression of the laws of SA. It is not only defamatory, but it is also hate speech." (original: Laat die mo*r vrek ons BOERE gan hom mos nie mis nie wat het dai rubber nek vir ons wittes gedoen absoliet fokkol so lat hy vrek ek gan homie mis nie ek sal nog op sy graf gan k*k
Based on the following, I urge you to please act immediately:
Section 10 of the Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA) prohibits any person from publishing or communicating "words based on one or more of the prohibited grounds (including race), against any person, that could reasonably be construed to demonstrate a clear intention to (a) be hurtful; (b) be harmful or to incite harm; or (c) promote or propagate hatred."
This freedom is qualified in section 16(2) of the Constitution which states that freedom of expression "does not extend to propaganda for war; incitement of imminent violence; or advocacy of hatred that is based on race, ethnicity, gender or religion, and that constitutes incitement to cause harm".
