Dear Uxbridge Town Residents:
Please consider supporting and signing this petition to urge the Uxbridge Town Planning Board on January 9, 2013, to vote NO to the proposal for a special permit by Evergreen Development to establish an ASPHALT manufacturing plant (concrete drum mixer) at 586 Quaker Hwy, Uxbridge, MA. This is less than ONE mile down the street from our new Uxbridge High School.
According to the Board of Selectman, we as a town voted on November 15, 2011 at our town meeting to remove the previously established town Bylaw that was amended in 1995 to PROHIBIT asphalt plants, manufacturing of asphalt, etc in the town of Uxbridge.
A little history on this for the current Uxbridge town residents... there were many concerned residents who in 1995 spent a lot of time and money to ensure that by a Special Town vote on June 19, 1995 an amendment to our bylaw was voted in and established as follows:
Article 5. Moved that the Town vote to amend the zoning by-laws, section VIII, Subsection B- Prohibited Uses, by adding the following:
Bituminous asphalt batching and/or mixing/manufacturing plants and/or bituminous asphalt mixing/manufacturing equipment, machinery, structures and buildings related to the manufacture thereof."
This should have appeared under the now-titled Article III, Section 400-10-D. Prohibited Uses.
According to the Town Manager and the Board of Selectman, we as a town voted on November 15, 2011 to amend Appendix A, which under the new bylaw would allow the Uxbridge Planning Board to award special permits under the title Industrial uses.
Then also in this very same motion... we as a town moved to alter the Article X Definitions and changed the definition of a Manufacturing Establishment: "any business the primary function of which is the assembly, fabrication, processing, and reprocessing of materials that is NOT dangerous by reason of fire, explosion, or other hazard, and does not produce excessive dust, odors, gas, smoke, vibration, noise, or electromagnetic interference, and which would not be detrimental to the neighborhood, or the town of Uxbridge. Specifically excepted are tanneries, wood pulp or paper mills, meat packaging, slaughter houses, and/or meat rendering, and pet food plants which are prohibited. Any other use specifically referenced under this bylaw shall be governed by those specific sections."
THIS IS VERY IMPORTANT because this vote single handedly removed any mention of asphalt manufacturing, etc from our Bylaws, and also gave our town Planning Board the power to award a special petition for industrial manufacturing.
On Novemeber 15. 2011, our town officials did NOT specifically inform us that we were voting and allowing the removal and omittence of the word asphalt and essentially dismantling the amended bylaw passed in 1995 to prohibit any and all asphalt plants in the Town of Uxbridge.
NOW, we are faced with a Planning Board that is at this time looking very favorably on awarding Evergreen Development a Special Permit to allow an asphalt (concrete mixing drum) manufacturing plant here in the Town of Uxbridge. This decision may and will likely be decided at the next Town Planning Board Meeting on January 9, 2013 at 7pm a the Uxbridge Town Hall.
DID WE AS A TOWN UNDERSTAND THAT WE WERE REMOVING AN ALREADY ESTABLISHED AND VERY IMPORTANT PART OF AN AMENDED BYLAW BY VOTING ON ARTICLE 10: Amending the zoning bylaws on November 15, 2011 ?
There appears to have been a specific agenda in the above proposal to amend Article 10 on November 15, 2011.
PLEASE HELP US TO SEND A MESSAGE TO THE UXBRIDGE TOWN PLANNING BOARD on January 9, 2013, THAT NOT ONLY DO WE AS UXBRIDGE RESIDENTS DEMAND THAT THEY VOTE "NO" AND DENY THIS SPECIAL PERMIT FOR AN ASPHALT PLANT BECAUSE IT IS NOT IN THE BEST INTEREST OF THE TOWN OF UXBRIDGE OR THE HEALTH OF ITS RESIDENTS. IT IS ALSO IMPORTANT THAT WE SEND THE MESSAGE TO OUR ELECTED TOWN OFFICIALS THAT WE DO NOT APPRECIATE THE MANNER IN WHICH THIS WAS HANDLED STARTING ON NOVEMBER 15, 2011.
