1. This state-based legislative campaign requires governors to validate the legality of federal National Guard call-ups before relinquishing control.
2. What this campaign adds is: A strong legal basis for state governments to keep the Guard home and 501C3 educational outreach opportunities.
3. The legislation is in play in a dozen states, with more on the way!
4. It recognizes that there is no existing Presidential authority for deploying Guard units to Iraq. The legislation looks to the 2002 AUMF bill.
5. The Congressional authorizations for military force passed in 2001 and 2002 are no longer valid, so cannot support federal call up of Guard forces.
