Dear Friend, over 37 years ago, in Louisiana, three Black Panthers were silenced for trying to expose continued segregation, systematic corruption and horrific abuse in the biggest and most brutal prison in the US, an 18,000 acre former slave plantation called Angola State Penitentiary. They charged Herman Wallace, Albert Woodfox and Robert King with murders they did not commit and threw them into 6X9 foot cells in isolation for nearly 37 years. Robert was released in 2001, but Herman and Albert remain behind bars.
In July 2008, a Federal Judge overturned Albert Woodfox’s conviction after a State Judicial Magistrate found his trial was unfair due to inadequate representation, prosecutorial misconduct, suppression of exculpatory evidence and racial discrimination in the grand jury selection process. Despite the State’s objections, this ruling was confirmed Sept. 2008. The State appealed the decision to the 5th Circuit in March 2009 and that decision is pending.
In November, 2006, a State Judicial Commissioner issued a 27 page report recommending the reversal of Herman Wallace’s conviction because of new evidence exposing prosecutorial misconduct, not disclosing to the jury that the main witness was a paid informant. After stalling for a year, the District Court rejected the Commissioner’s recommendation. In May, 2008, an appellate court continued to ignore justice by refusing to hear the case in a 2-1 decision. The dissenting judge determined that Herman’s constitutional rights had been violated. The case is currently on appeal at the Louisiana Supreme Court.
These three men have also filed a Civil Suit in Federal Court, detailing the decades of unconstitutionally cruel and unusual punishment endured in solitary confinement for 29 and 37 years. Prison officials are required to hold 90 day reviews to justify keeping inmates in solitary confinement for and this was not done.
