Tell Governor Rick Scott to commute the sentencing of Cristain Fernandez. No forced plea deals.

http://www.flgov.com/contact-gov-scott/ contact Governor Rick Scott and ask him to commute Cristians sentence. by anotherlawyer This story fails to give all of the relevant background details. First, Fernandez was barely 12 when he allegedly killed his brother and there is no evidence that he broke his brother's leg - the mother here pled guilty to lesser charges very quickly in order to avoid potential liability later - especially since children Fernandez's age are at great risk for false confession syndrome. It is not unheard of for children to take responsibility for parents in such situations. Also, Angela Corey charged Fernandez with first degree murder by bootstrapping an overt accidental killing to a felony child abuse charge as the underlying felony. This is a disgraceful act by a prosecutor - especially where a 12 year old child is concerned. There is zero evidence that Fernandez knowingly or willfully harmed his brother - the claim is that he shoved his brother into a shelf. Corey has the record in Florida for condemning the most children in the state to adult prison - many to die there. She argued in court that Fernandez should be locked up in an adult facility in the "hole" (for his own protection) at age 12 and 5 months. Even the judge couldn't stomach that and sent him back to Juvie - but Corey had already kept Fernandez away from caring adults interested in his welfare for several months and forced him into three weeks of solitary confinement in the adult jail. Fernandez was forced to babysit this two year old toddler, his five year old brother and another child on a routine, daily basis, for hours at a time. Imagine yourself babysitting three under five or even two or one toddler. Lose patience yet? Imagine a barely 12 year old, forced into the role of family disciplinarian - the toddler is tearing up the house and throwing his urine-soaked clothes around, the five year old is running for the door half naked, and the baby is screaming. What's a 12 year old boy to do? Perhaps he yells at the toddler and shoves him - a little too hard. Then, he immediately calls his Mommy and in complete terror waits for her arrival - where she thereupon waits 8 hours before obtaining treatment. Does Fernandez really sound like a psychopath now that you know this information? Corey is a monster - a legalized serial child abuser of the worst sort who was appointed to handle the Trayvon Martin case to rehabilitate her disgusting and abusive reputation. She is being opposed by a team of local lawyers who are defending Fernandez for free because they are so horrified by Corey's abuse of the law in this case. Felony murder might make sense for an adult - but for a little boy who just passed his 12th birthday? A little boy who has been brutally abused and is under horrific stress to care for three toddler siblings? Manslaughter is manslaughter - NOT murder. This is an involuntary manslaughter case - not an intentional first degree murder case. Corey hopes to fool you all so you will presume the boy guilty and lacking the ability to reform. Kids who accidentally kill younger siblings are not known to re-offend and are not psychopaths. If Fernandez had raped the two year old and suffocated him for the enjoyment of seeing him die, I would have a another perspective. But getting angry at age 12 because you're cooped up with babies and going over the edge and accidentally harming one does not a murderer make.

Cristian will have to needlessly stay in a juvenile facility until his 19 th birthday if the Governor does not commute his sentence.  Cristian is innocent and was railroaded.

Please contact Governor Rick Scott and ask him to commute the sentence of Criastian Fernandes. Angela Corey and Mark Caliel wanted to give Cristian LIFE WITHOUT PAROLE which forced him into a plea deal of something that was never proven.

We have the world largest prison population, each working for $1.5 per a hour (suck on that China). It is cheaper to own a prisoner than a slave. I strongly suggest owning prisoners (buying stocks of prison corporations) specially if there is any chance of you may ending up in one in future. According to prison guards union, growing prison population is vital to our economy since it keep the national unemployment rate down and they successfully lobby for tougher laws and harsher punishments....

We already had situations prison corporations encouraging judges to send minors to jail, prosecutors been enthusiastic about institutionalizing minors (Cash for Kids). Kids are more profitable.

Donna Evans That's right, Donna. There is an article in The Sun about this.

I realize we are getting a little off topic here, but please folks, let's pass these articles on to others on FB, Twitter, MySpace, etc.
P.S. I didn't find the interview in The Sun, but it was Michelle Alexander that was being interviewed so we can read directly from her article.
If you like interviews, The Sun magazine has a new one every issue (once a month). And it is ad free. So they don't have to worry about offending their sponsors.

We send our boys over to kill. We make our money off selling weapons both here and abroad and now we have a new business: jail young men for smoking a little pot (which has a dubious history for why it is illegal, to begin with); the judges, lawyers, guards, police all get to make money while many are afraid to even jaywalk. SAD . . . but true.

I am simply sickened at the cruelty of bringing criminal charges against a child of 12; what has become of human decency? are there no adults among us? no one to defend and protect a minor? May God help us reclaim the most basic natural trait of animals who tend their young until they are capable of protecting themselves. Shame, shame on child abusers.

Millie, I wish there were more people like you in this world.

I can't believe this. I had the same experience of saving a child who was locked up in a Juvenal cell for more than 3 years. His crime? At age 9, he was playing with a friend and the friend ended up falling on a rock leading to his death. This young boy was locked up behind bars without education and from his parents for over 3 years until I stepped in with some colleagues and we worked for his released.

If there are people in the system who themselves had problem with abuse and they could not work on themselves, and do not see what they went through themselves as being wrong, they would always think that such actions are right and would never see anything wrong with the cruel treatment of children irrespective of what the children have done.
How many children has this man sent to prison under the pretest of protecting them? Is there no law against such maltreatment of kids in the States? To some of us outside the US, when it comes to the treatment of children, it is becoming clear that the US has nothing to boast off - a country which is destroying its own young ones. You maltreat them young and later become surprise about the way they behave in their adulthood. Garbage in garbage out!

It is really weird how I read and hear news how adults get away with murder because of a well payed lawyer (and who knows what other people) and a 12 yr old is being used as an example without really studying his case. The mother should be the one to be prosecuted. Children should not be taking care of children. You brought them into this world, you take care of them! My prayers for this child that everything will come into the light and the cruel people profiting from this case will see what it's store for them in the future. I believe in a HIGHER JUSTICE.

Angel's Unite

Your absolutely right, AND SO SHOULD THE SYSTEM- ATTORNEYS, EXC. WHO ALLOWS THIS TO CONTINUE.

We want Cristian to be treated as a child not as an adult. Children should never be charged as adults especially a 12-year old abused and neglected boy.
We want the prosecutor to either drop the adult charges or send the case back to juvenile court where the case belongs. "Email State Attorney Angela Corey (ACorey@coj.net) and Assistant State Attorney Mark Caliel (MCALIEL@coj.net) and ask them to drop the misplaced and abusive adult charge against 12-year old Cristian.

It should have never been a trial. Christian was only try to do displine the child which his mother should been there in the first place.

I think its so sad for this littlw boy to get acused of this its not right at all .He really should not b locked up..The mother needs to b in jail not the child for real

Should not be that Angela Corey the one prosecuted and put in jail, instead of that boy?

By the way why wasn't Cristians mother sentenced yet?
