Dear officials of the Sudanese judicial system,
On August 13th 2012, the sentence hearing of Rudwan Dawod and Ahmed Kwarty will take place at Alhaj Youseef Court House.
We petition the Sudanese Judicial System and its respected officials to release Mr. Dawod and Mr. Kwarty without any further delay or violation of their human and constitutional rights.
These two individuals did not advocate violence in any way and they were merely practicing their rights as granted to them by the constitution of Sudan.
August 13th 2012 is not merely a trial of two individuals, it is rather a test for the integrity and transparency of the Sudanese judicial system itself.

Rudwan Dawood and Ahmed Kawarty are two Sudanese peace advocates and activists calling for a peaceful change of Al-Bashir regime in Sudan— the same regime which reached power through a military coup against an elected government.
Rudwan and Kawarty are currently on trial for attempting to overthrow the government by force and they might face the death penalty. The accusations are based on leaflets found with them upon their arrest. The leaflets called for peaceful demonstrations to overthrow the government and did not advocate violence.
Rudwan and Kawarty were arrested and tortured with a number of their fellow activists in a clear violation of their human rights.
Rudwans's father and his younger brother Sofian, 18 yrs old, were arrested and tortured along with him. As a result Sofian was admitted to a mental asylum due to a mental deterioration caused by torture.
Rudwan's American wife is pregnant of their daughter who they planned to name "Sudan."
The sentence hearing of Rudwan and Kwarty will take place on Monday August the 13th at Alhaj Youseef Court House.
Rudwan and Kwarty were merely practicing their rights as granted by the Sudanese constitution, and they did not advocate violence in any way. We petition for their release and we consider the 13th of August a test for the integrity of the Sudanese judicial system.

    Rudwan is free.

But he was ordered by the NISS to:

    1- Leave Sudan ASAP.
2- Not stay with his family in their house located at Al-Haj Yousef neighborhood.
3- Show up at the NISS office every morning before 10:00 AM.

It's also important to note that when the NISS raided Rudwan's house to arrest him, they confiscated money, electronics, camera, iPhone, and other items. The NISS claim they don't know who took them, and these items were not returned to Rudwan until now.

Court issues verdict in Rudwan and Kawarti's case
NISS Rearrests Rudwan Dawod before he leaves court premises

Abbas Mohamed Khalil, Criminal Court Judge, dismissed the case against Ahmed Kawarti and Rudwan Dawod today August 13. He ordered Rudwan to pay a fine of 500 Sudanese Pound and considered his detention during the trial adequate to compensate for his punishment under the article (19) which states "attempting" to disturb the public peace. Activist attending the trial collected the amount due for the fine and paid it off to expedite celebrating Rudwan's release. However, a National Intelligence and Security Service (NISS) Captain, Al-Tayb Abdulrahman, threatened Rudwan before the judge that he is not free yet even if the Court said so. Captain Abdulrahman had a warrant ready while the lawyers were finalizing the release of Rudwan. NISS official paper ordered the transfer of Rudwan to NISS custody without pressing any charges or uttering any accusations, which is legal per Public Order Law. This is act is disrespectful to judicial prestige and allows NISS to act as a higher power that could supersedes court orders.

Rudwan has been detained since July 3. He has been subject to torture and abuse during his detention and he was threatened repeatedly to be assassinated. Two judges rescheduled Rudwan's trial twice because execution sentences was not among their jurisdiction.

Girifna condemns the outrageous action of re-arresting Rudwan by NISS and demands his immediate release to rejoin his wife who is due to have their first baby girl very soon. Court found Rudwan innocent and NISS should not disrespect Court and arrest him without pressing charges. This legal chaos harms the justice and should be put to an end.

Rudwan could be detained at the NISS headquarters, but activists can't confirm this yet.

  4. Update #3

Posted by Modic Bari (Campaign Leader) on Aug 13, 2012

Al-Bashir's NISS arrested Rudwan who was found by the judicial system "NOT GUILTY" this morning (Aug 13th 2012) and took him to an unknown location.
We call for his immediate release.

*It's ironic that Al-Bashir was nominated for a Seat in the UN Human Rights Council despite of all his crimes and violations of human rights.

It's important to note that Al-Bashir regime has arrested Rudwan again; arrested a man who was found by the judicial system "NOT GUILTY" this morning (Aug 13th 2012)

It's ironic that Al-Bashir is nominated for a Seat on the UN Human Rights Council.

    Thanks for your support!
Both detainees were found NOT GUILTY.
Ahmed Kawarty was released immediately, whereas Rudwan was charged with 500 Sudanese pounds fine (the crowd collected and paid the money on his behalf in a matter of minutes.)
What was really surprising that the National Intelligence Secret Service arrested Rudwan again upon his release and took him to an unknown location!
